Terms of Service

1. Introduction and Acceptance

These Terms of Service (the “Terms”) constitute a binding legal agreement between you (the “Player” or “you”) and Afri-Millions Limited, a company registered in Nigeria (company number 7440384) with its registered office at 29 Ribadu road, Ikoyi, Lagos (“AfriMillions”, “we”, “us”, or “our”).

By purchasing a lottery ticket, creating an account, or otherwise participating in any AfriMillions lottery game or service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Responsible Gaming Policy, our AML and CDD Policy, and all applicable laws and regulations.

If you do not agree to these Terms, you must not participate in AfriMillions games or services.


2. Eligibility and Age Restriction

2.1 Minimum Age Requirement

You must be at least 18 years of age to participate in AfriMillions lottery games. It is an offence under Nigerian law for any person under the age of 18 to purchase lottery products or claim prizes. We reserve the right to request proof of age at any time, and failure to provide satisfactory evidence will result in forfeiture of tickets and prizes.

2.2 Geographic Restrictions

AfriMillions lottery games are operated under license from the Lagos State Lotteries and Gaming Authority (LSLGA). Our services are intended only for individuals who are physically present in Nigeria at the time of purchase and who are legally permitted to participate in lottery and gaming activities under Nigerian law and any applicable state law.

Where our licence or regulatory approvals limit our operations to specific states or territories, participation is restricted accordingly. We may block access, cancel tickets, or withhold prizes where participation would breach any applicable state, federal, or international law or regulation.

By participating, you confirm that you are physically present in Nigeria at the time of purchase, that you are not in a jurisdiction where participation in AfriMillions games is unlawful, and that you will comply with all applicable laws in your location. You must not use our services from any country or territory where participation in AfriMillions games would be unlawful or where we are not authorised to operate, and we may cancel tickets or withhold prizes where we reasonably believe this requirement has been breached in order to comply with applicable law.

2.3 Prohibited Persons

The following persons are prohibited from participating in AfriMillions lottery games:

  • Individuals under 18 years of age
  • Employees, directors, and immediate family members of Afri-Millions Limited
  • Employees and agents of our technology providers, payment processors, and regulatory authorities (including LSLGA and NLRC)
  • Persons who have been excluded or self-excluded from gaming activities, including under any applicable regulator-managed exclusion scheme
  • Persons prohibited by law or court order from participating in gaming activities

3. Account Registration and Security

3.1 Account Creation

To participate in online lottery games, you must create an account by providing accurate, current, and complete information including your full legal name, date of birth, email address, phone number, and residential address.

3.2 Account Verification

We are required by law to verify your identity. You may be required to provide:

  • Valid government-issued identification (National Identity Number, Bank Verification Number, International Passport, Driver’s Licence, or Voter’s Card)
  • Proof of address (utility bill, bank statement, or tenancy agreement)
  • Additional documentation as required for Anti-Money Laundering (AML) and Customer Due Diligence (CDD) compliance

Failure to provide requested verification documents may result in account suspension and, where permitted by law, forfeiture of winnings directly connected to the failure to verify.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must:

  • Choose a strong, unique password
  • Not share your account credentials with any third party
  • Notify us immediately if you suspect unauthorized access to your account
  • Ensure your contact information is current and accurate

AfriMillions is not liable for any loss or damage arising from unauthorized account access due to your failure to maintain security.

3.4 One Account Per Person

Each individual may hold only one AfriMillions account. Multiple accounts registered by the same person will be closed, and associated tickets and winnings may be forfeited where necessary to prevent fraud or comply with regulatory requirements.


4. Purchasing Tickets and Gameplay

4.1 How to Play

AfriMillions lottery tickets may be purchased:

  • Online through our website or mobile application
  • Through authorized retail agents and point-of-sale (POS) terminals
  • Via other authorized distribution channels

All ticket purchases are final. Tickets cannot be cancelled, refunded, or exchanged once issued, except as required by law or these Terms.

You must not purchase tickets or use our services from any country or territory where participation in AfriMillions games would be unlawful or where we are not authorised to operate. We may cancel tickets, restrict access, or withhold prizes where we reasonably believe this requirement has been breached in order to comply with applicable law or regulatory directions.

4.2 Game Rules

Each AfriMillions lottery game has specific rules governing gameplay, draw schedules, prize structures, and odds of winning. Full game rules are available on our website and at authorized retail locations. It is your responsibility to understand the rules before playing.

4.3 Draw Integrity

All draws are conducted using certified random number generation equipment or processes approved by the Lagos State Lotteries and Gaming Authority. Draw results are final and binding. Draw times, frequencies, and procedures are set out in the applicable game rules.

If, due to technical failure, regulatory direction, or other circumstances beyond our reasonable control, a draw cannot take place as scheduled or is declared invalid, we may postpone the draw or void affected tickets and refund the ticket purchase price, in each case in accordance with the applicable game rules and any directions from LSLGA or other relevant regulators.

4.4 Ticket Validation

To be valid, a ticket must:

  • Be purchased through authorized AfriMillions channels
  • Contain a valid, unique ticket reference number
  • Not be torn, defaced, altered, or tampered with
  • Be presented within the claim period specified in the game rules

AfriMillions reserves the right to refuse payment on any ticket that fails validation checks or where fraud or manipulation is suspected, provided that such refusal is consistent with applicable law, our licence conditions, and any directions from regulators.


5. Prizes and Claims

5.1 Prize Amounts

Prize amounts and structures are specified in the applicable game rules. Prizes are subject to any applicable deductions including gaming taxes, withholding taxes, and verification fees as required by Nigerian law.

5.2 Claiming Prizes

Small Prizes (Below ₦5,000,000): May be claimed online via your AfriMillions wallet or at authorized retail agents, subject to verification.

Large Prizes (₦5,000,000 and Above): Require enhanced verification including identity confirmation, proof of address, and completion of Customer Due Diligence procedures in accordance with our AML Policy.

Very Large Prizes (₦20,000,000 and Above): Require Enhanced Due Diligence (EDD) including verification of source of wealth and senior management approval before payout.

5.3 Claim Period

All prizes must be claimed within 90 days of the draw date, unless otherwise specified in the game rules. Unclaimed prizes after the claim period expires will be forfeited and dealt with in accordance with LSLGA regulations and any other applicable laws. Where required by law or our licence conditions, unclaimed prizes may be returned to prize funds, allocated to good causes, or otherwise applied as directed by the relevant regulator. We will not appropriate unclaimed prizes for our own benefit except as expressly permitted by applicable law and licence conditions.

5.4 Payment Methods

Prizes will be paid:

  • To your AfriMillions wallet for online players
  • Via bank transfer to your verified Nigerian bank account
  • By other secure, traceable payment methods approved by AfriMillions

Cash payments are not available for prizes above ₦50,000. All prize payments are subject to our Cashout Policy and applicable transaction fees.

5.5 Tax and Legal Obligations

Prize winners are responsible for any tax obligations arising from their winnings in accordance with Nigerian tax law. AfriMillions may be required to withhold taxes or report winnings to the Federal Inland Revenue Service (FIRS) or other authorities.

5.6 Publicity

By accepting a prize, you consent to the use of your name, photograph, and likeness by AfriMillions for promotional and publicity purposes, unless prohibited by law. You may opt out of publicity by notifying us in writing at the time of claim, except where disclosure is required by law, regulation, or a regulator.


6. Responsible Gaming

6.1 Our Commitment

AfriMillions is committed to promoting responsible gaming and preventing problem gambling. We provide tools and resources to help you play responsibly, including:

  • Voluntary spending limits
  • Self-exclusion options
  • Session time reminders
  • Access to play history and spending data

We will comply with any applicable regulator-managed self-exclusion schemes and will take reasonable steps to ensure that self-exclusion is enforced across all our channels, in accordance with regulatory requirements.

6.2 Play Responsibly

Gaming should be a form of entertainment, not a way to make money. We encourage you to:

6.3 Self-Exclusion

7. Anti-Money Laundering and Financial Crime Prevention

7.1 AML Compliance

AfriMillions operates in full compliance with the Money Laundering (Prevention and Prohibition) Act 2022, SCUML AML-CFT-CPF Regulations 2024, and all applicable Nigerian financial crime legislation.

7.2 Know Your Customer (KYC)

We are legally required to verify the identity of all players and prize claimants. You must provide accurate information and documentation when requested. We will conduct:

  • Standard Due Diligence: For prizes above ₦5,000,000 (or such other thresholds as may be required by law or regulations from time to time)
  • Enhanced Due Diligence: For prizes above ₦20,000,000, Politically Exposed Persons (PEPs), high-risk customers, or where otherwise required by law or regulatory guidance

7.3 Transaction Monitoring

All transactions are monitored for suspicious activity. We may delay or refuse prize payments if we suspect money laundering, fraud, or other financial crime. Suspicious transactions will be reported to the Nigerian Financial Intelligence Unit (NFIU) and any other relevant authority as required by law.

7.4 Source of Funds

For large prize claims and higher-risk situations, we may require you to provide evidence of your source of wealth and source of funds. Failure to provide satisfactory evidence may result in delay or non-payment of prizes, account restrictions, and the filing of reports with NFIU or other authorities, where required by law.

7.5 Sanctions Screening

We screen all players against international and Nigerian sanctions lists. We cannot accept participation from or make payments to sanctioned individuals or entities.

8. Payments and Wallet

8.1 AfriMillions Wallet

When you create an account, you will be provided with an AfriMillions wallet to hold funds for ticket purchases and receive winnings.

8.2 Deposits

You may fund your wallet using:

  • Bank transfer
  • Debit card
  • Authorized payment service providers (Moniepoint/Monnify, OPay)
  • Other approved payment methods

All deposits must originate from a Nigerian bank account or payment method in your own name. We may refuse deposits from accounts or payment instruments that do not match your registered details or that we reasonably suspect are associated with fraud, money laundering, or other unlawful activity.

8.3 Withdrawals

Withdrawals from your wallet are subject to:

  • Identity verification and AML checks
  • Transaction fees as set out in our Cashout Policy
  • Minimum and maximum withdrawal limits
  • Processing times based on transaction value

Automatic processing: Withdrawals up to ₦50,000

Manual approval required: Withdrawals above ₦50,000

Withdrawals will only be made to a verified Nigerian bank account in your own name.

8.4 Dormant Accounts

If your account remains inactive (no gameplay or wallet transactions) for a continuous period of 12 months, it may be classified as dormant. Before classifying an account as dormant, we will provide you with reasonable notice using your registered contact details and give you an opportunity to reactivate your account.

Once an account is classified as dormant, we may, in accordance with applicable law and regulatory requirements:

  • Apply a reasonable monthly dormancy fee of up to ₦500, and/or
  • Restrict certain account functions, and/or
  • Close the account after further notice.

Any dormancy fees, restrictions, or closures will be applied in a fair and proportionate manner and only to the extent permitted by law and our licence conditions. Any remaining positive balance on a dormant or closed account will be handled in accordance with applicable law and regulator directions, and, where permitted, you may reclaim such funds by contacting customer service and completing any required verification checks.


9. Prohibited Activities and Fraud

9.1 Prohibited Conduct

You must not:

  • Use the service for any unlawful purpose
  • Purchase tickets on behalf of minors or prohibited persons
  • Engage in money laundering, fraud, or financial crime
  • Use automated systems, bots, or software to purchase tickets (except as authorized)
  • Attempt to manipulate, hack, or interfere with our systems
  • Collude with other players or agents to gain unfair advantage
  • Use stolen payment methods or false identity information
  • Engage in bonus abuse or exploitation of promotional terms
  • Use our services from any country or territory where participation in AfriMillions games would be unlawful or where we are not authorised to operate

9.2 Fraud and Security Investigations

AfriMillions reserves the right to:

  • Investigate any suspected fraud, cheating, or breach of these Terms
  • Suspend or close accounts pending investigation
  • Withhold prizes and funds where fraud is suspected, subject to applicable law and regulatory requirements
  • Report criminal activity to law enforcement and regulatory authorities
  • Recover losses through legal action

9.3 Consequences of Breach

If you breach these Terms, we may:

  • Suspend or permanently close your account
  • Void tickets and forfeit prizes that are directly connected to the breach
  • Temporarily withhold funds or prizes while we investigate
  • Pursue civil recovery or criminal prosecution where appropriate
  • Report you to regulatory authorities, law enforcement, and financial intelligence units

Any suspension, closure, forfeiture, or withholding will be carried out in accordance with applicable law and regulatory requirements and in a fair and proportionate manner. Where permitted by law, you will be informed of the reasons for any such action and may contact us to request further information or to challenge our decision.


10. Privacy and Data Protection

10.1 Data Collection and Use

We collect, process, and store your personal information in accordance with the Nigeria Data Protection Act 2023 (NDPA) and our Privacy Policy. This includes information provided during registration, verification, gameplay, and customer service interactions.

10.2 Purpose of Processing

We process your data to:

  • Operate lottery games and process transactions
  • Verify your identity and comply with AML obligations
  • Prevent fraud and ensure security
  • Communicate with you about your account and our services
  • Comply with legal and regulatory requirements
  • Improve, personalise, and develop our products and services

10.2A Lawful Bases for Processing

We process your personal data only where we have a lawful basis under the Nigeria Data Protection Act 2023. Depending on the context, we rely on one or more of the following lawful bases:

  • Performance of a contract: to create and manage your account, sell tickets, process payments, pay prizes, and provide customer support
  • Compliance with legal and regulatory obligations: to meet our obligations under gaming laws, AML/CFT regulations, tax laws, and orders from regulators and law enforcement
  • Legitimate interests: to operate, secure, and improve our services, prevent fraud and abuse, manage our relationship with you, and protect our legal rights, provided that such interests do not override your fundamental rights and freedoms
  • Consent: for certain types of marketing communications and any other processing where consent is the appropriate lawful basis. Where we rely on your consent, you may withdraw it at any time using the methods described in our Privacy Policy, without affecting the lawfulness of processing based on consent before its withdrawal.

10.5 Data Retention

We retain your personal data only for as long as necessary to fulfil the purposes described in these Terms and our Privacy Policy, and to comply with legal, regulatory, tax, accounting, and anti-money laundering record-keeping obligations. This typically requires us to retain certain information for at least 5 years after your account is closed or after the relevant transaction or business relationship has ended, or for any longer period required by law or by a regulator.

When personal data is no longer required for these purposes, we will securely delete, anonymise, or otherwise dispose of it in accordance with NDPA and any applicable regulations.

10.6 International Data Transfers

Some of our service providers, technology partners, or data storage solutions may be located outside Nigeria. Where this involves the transfer of your personal data to another country, we will ensure that such transfers comply with the Nigeria Data Protection Act 2023 and any guidance issued by the Nigeria Data Protection Commission.

This may include transferring data only to countries that provide an adequate level of data protection, putting in place appropriate contractual safeguards (such as standard contractual clauses or data protection agreements), or relying on other lawful transfer mechanisms approved under NDPA. 10.7 Automated Decision-Making and Profiling

We may use automated tools and profiling to help detect fraud, manage AML/CFT risk, monitor responsible gaming behaviour, and tailor certain communications and offers. Where automated decision-making is used in a way that produces legal effects concerning you or significantly affects you, we will implement appropriate safeguards, including the right to:

  • Obtain human intervention
  • Express your point of view
  • Contest the decision

11. Advertising, Promotions, and Bonuses

11.1 Promotional Terms

From time to time, we may offer promotions, bonuses, or special offers. Each promotion is subject to specific terms and conditions which will be clearly communicated. Promotional terms form part of these Terms.

11.2 Marketing Communications

By creating an account, you may be asked to indicate your preferences for receiving marketing communications from AfriMillions via email, SMS, push notification, or other channels. We will only send you direct marketing communications where we have a lawful basis to do so, which will usually be your consent or, in some cases, our legitimate interest, subject to your right to object.

You may withdraw your consent or change your marketing preferences at any time by:

  • Using the unsubscribe or opt-out link in our emails or SMS
  • Adjusting your preferences in your account settings (where available)
  • Contacting our customer service team

Withdrawing consent or opting out of marketing will not affect your ability to use our core services, but you may miss out on certain offers or promotions.

11.3 Advertising Standards

All AfriMillions advertising and promotional materials:

  • Are truthful and not misleading
  • Do not target or appeal to minors
  • Include the 18+ age restriction symbol
  • Promote responsible gaming messages

We will not depict gambling as a solution to financial problems or a guaranteed source of income and will avoid content that exploits vulnerable individuals.


12. Intellectual Property

12.1 Ownership

All content on the AfriMillions website, mobile application, and related materials, including logos, trademarks, game names, text, graphics, software, and design elements, are the exclusive property of Afri-Millions Limited or its licensors and are protected by Nigerian and international intellectual property law.

12.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the AfriMillions services for personal, non-commercial use only. You may not:

  • Copy, reproduce, or distribute our content
  • Modify, reverse engineer, or create derivative works
  • Use our trademarks, logos, or branding without written permission
  • Frame or embed our content on other websites

13. Limitations of Liability

13.1 Service Availability

While we strive to ensure continuous service, we do not guarantee that the AfriMillions website, mobile app, or services will be available at all times without interruption. We are not liable for:

  • Technical failures, system outages, or maintenance downtime
  • Internet or network connectivity issues
  • Third-party service provider failures
  • Force majeure events (natural disasters, war, civil unrest, etc.)

13.2 Liability Cap

To the maximum extent permitted by Nigerian law, AfriMillions’ total liability to you for any claim arising from these Terms or your use of our services shall not exceed:

  • The amount of your valid ticket purchase, or
  • The verified prize amount owed, whichever is applicable

13.3 No Indirect Damages

We are not liable for any indirect, incidental, consequential, or special damages including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages, except where such exclusion is not permitted under applicable Nigerian law.

13.4 Your Responsibility

You are responsible for:

  • Ensuring your equipment and internet connection are suitable for using our services
  • Keeping your account credentials secure
  • Verifying your ticket details and checking draw results
  • Claiming prizes within the specified time period

14. Dispute Resolution

14.1 Customer Complaints

If you have a complaint or dispute, please contact our customer service team at help@afri-millions.com. We will investigate and respond within 14 business days.

14.2 Regulatory Complaints

If you are not satisfied with our response, you may escalate your complaint to the Lagos State Lotteries and Gaming Authority (LSLGA) in accordance with their complaints procedure and, where applicable, to the National Lottery Regulatory Commission (NLRC).

14.3 Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. The Nigerian courts shall have exclusive jurisdiction over any disputes arising from these Terms, subject to the regulatory oversight of the LSLGA and other relevant regulators.

Where required by our licence conditions or by law, disputes may also be subject to the oversight or directions of relevant regulators, including the Lagos State Lotteries and Gaming Authority and the National Lottery Regulatory Commission.

14.4 Alternative Dispute Resolution

Where appropriate and agreed by both parties, disputes may be resolved through mediation or arbitration in accordance with Nigerian arbitration law before resorting to litigation.


15. Changes to Terms

15.1 Right to Modify

AfriMillions reserves the right to modify these Terms at any time to reflect changes in:

  • Applicable laws and regulations
  • LSLGA licensing requirements
  • Our business operations and services
  • Industry best practices

15.1A Regulatory Approval

Where required by law or by our licence conditions, material changes to these Terms or to key game rules will be notified to, or approved by, the Lagos State Lotteries and Gaming Authority or other relevant regulators before they take effect. Nothing in this section permits us to change these Terms in a way that would put us in breach of applicable law or regulatory requirements.

15.2 Notice of Changes

We will provide reasonable notice of material changes by:

  • Posting the updated Terms on our website with a new effective date
  • Sending email notification to registered users
  • Displaying a prominent notice on our platforms

15.3 Continued Use

Your continued use of AfriMillions services after changes take effect constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using our services and close your account.


16. Account Closure and Termination

16.1 Voluntary Closure

You may close your account at any time by contacting customer service. Upon closure:

  • Any remaining wallet balance will be returned to you (subject to verification and withdrawal procedures)
  • All pending tickets remain valid and prizes may still be claimed
  • Your personal data will be retained as required by law (typically a minimum of 5 years) and then deleted or anonymised in accordance with NDPA and our Privacy Policy

16.2 Termination by AfriMillions

We may suspend or terminate your account immediately without notice if:

  • You breach these Terms
  • We suspect fraud, money laundering, or criminal activity
  • You provide false or misleading information
  • You are or become a prohibited person
  • Required by law or regulatory order

16.3 Effect of Termination

Upon termination:

  • Your access to the services will be revoked
  • Valid tickets purchased before termination remain valid
  • Verified winnings will be paid (subject to investigation outcomes and applicable law)
  • Bonus funds and promotional offers will be forfeited

Any suspension or termination will be carried out in accordance with applicable law and regulatory requirements and in a fair and proportionate manner. 17. Regulatory Compliance and Licensing

17.4 Regulatory Cooperation

We will cooperate fully with the Lagos State Lotteries and Gaming Authority, the National Lottery Regulatory Commission, the Nigeria Data Protection Commission, the Nigerian Financial Intelligence Unit, SCUML, and any other competent authority in Nigeria. This includes providing access to records, systems, and information as required by law or licence conditions, submitting reports, and implementing any directions or remedial measures issued by such authorities.


18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, Responsible Gaming Policy, AML and CDD Policy, and any specific game rules, constitute the entire agreement between you and AfriMillions regarding your use of our services.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court or regulatory authority, that provision shall be removed and the remaining provisions shall remain in full force and effect.

18.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

18.4 Assignment

You may not transfer or assign your rights or obligations under these Terms. AfriMillions may assign these Terms to any successor entity or affiliate without your consent, provided that such assignment does not adversely affect your rights under applicable law.

18.5 Force Majeure

AfriMillions is not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government action, technical failures, or pandemics.

18.6 Language

These Terms are provided in English. In the event of any conflict between an English version and a translation, the English version shall prevail.
